Counselor Osama Al-Saidi indicated that his state of legal unconsciousness in the sports community was caused by the lack of disciplined regulations governing the work of the Disciplinary and Appeal Committees.
Counselor Osama Al-Saedi added that the procedural and substantive rules included in the regulations in this regard must be specific to deny ignorance, starting from the investigation of the complaint until the decision on it with a reasoned decision from the Disciplinary Committee, then the grievance stage comes before the Appeal Committee.
Counselor Osama Al-Saidi decided that the Disciplinary Committee’s regulations must include specific dates in all stages of the complaint from the beginning of its submission until its decision is decided upon by a decision of the Disciplinary Committee to ensure the speedy settlement of the complaint and the achievement of prompt justice, and that the regulations also include penalties that are appropriate to the incident subject of the complaint, taking into account the general provisions. The rules of individualization of punishment, which are intended to take into account the circumstances surrounding the incident, whether circumstances mitigating or aggravating the penalty, and the necessity of observing the Discipline and Appeal Committees for this, which is judicially applied in what is called judicial individualization.
In the end, Counselor Osama Al-Saedi stressed that sports disputes, especially in the field of football, have their own character, and sports culture and knowledge of the conditions for playing football and the pressures surrounding it must be available, along with knowledge of the legal rules governing the game of football.
